1. Objeto. SmartLeges es una aplicaci\u00f3n que ofrece acceso a las leyes.<\/p>\n
2. Uso del Software. Usted no puede hacer o distribuir copias de cualquier parte del Software, el cual es \u00fanicamente para su uso personal.<\/p>\n
3. Copyright. Este Software, su estructura, organizaci\u00f3n y c\u00f3digo pertenece a SmartLeges, y est\u00e1 protegido por las leyes internacionales sobre Copyright. Este contrato no le otorga ning\u00fan derecho intelectual sobre el Software. Usted esta de acuerdo en no copiar, modificar, traducir, adaptar, decompilar o realizar cualquier acci\u00f3n de ingenieria inversa sobre el Software.<\/p>\n
4. Sin garant\u00edas. Este Software se suministra tal cual es, y SmartLeges no ofrece ninguna garantia, expresa o impl\u00edcita, sobre su correcto funcionamiento, su rendimiento, o los resultados que se obtengan de su uso.<\/p>\n
5. Nuevas funcionalidades y aplicaciones. El usuario autoriza expresamente a SmartLeges a llevar a cabo acciones informativas y comerciales sobre las nuevas funcionalidades y\/o nuevas aplicaciones comercializadas a trav\u00e9s de la aplicaci\u00f3n Market, y a contestar a las sugerencias enviadas por el usuario, para lo que podr\u00e1 utilizar notificaciones dentro de la aplicaci\u00f3n, el correo electr\u00f3nico, redes sociales o cualquier otro medio telem\u00e1tico.<\/p>\n
6. Modificaciones y actualizaciones. SmartLeges se reserva la facultad de efectuar, en cualquier momento y sin necesidad de previo aviso, modificaciones y actualizaciones de la informaci\u00f3n contenida en la aplicaci\u00f3n, de la configuraci\u00f3n, disponibilidad y presentaci\u00f3n de \u00e9sta, as\u00ed como de las presentes Condiciones de Uso.<\/p>\n
6.1. App Stores.\u00a0 You acknowledge and agree that the availability of the SmartLeges Software is dependent on the third party from which you received the SmartLeges Software, e.g., the Android Market or Apple app store (each, an \u00abApp Store\u00bb).\u00a0 You acknowledge that this Agreement is between you and SmartLeges and not with the App Store.\u00a0 Each App Store may have its own terms and conditions to which you must agree before downloading the SmartLeges Software from it.\u00a0 You agree to comply with, and your license to use the SmartLeges Software is conditioned upon your compliance with, all applicable terms and conditions of the applicable App Store.<\/p>\n
6.2. Payments. Cancellation. Final Sale:\u00a0 Any and all payments made to SmartLeges for use and access to any SmartLeges Services and SmartLeges Software are final and all charges are nonrefundable. Cancellations are effective the following billing period in which payment is due. You will not receive a refund for any payment amount, even if payment was made for multiple billing periods. If you have an account set up for reoccurring billing, you may cancel your account at any time. You will continue to have the same access for any billing period or periods for which you have paid. If your profile content or your conduct within the SmartLeges Software or SmartLeges Services violates our Terms of Service, your access and account may be immediately terminated and all payments forfeited.<\/p>\n
7. Apple App Store Additional Terms and Conditions.\u00a0 The following additional terms and conditions apply to you if you are using a SmartLeges Software from the Apple App Store.\u00a0 To the extent the other terms and conditions of this Agreement are less restrictive than, or otherwise conflict with, the terms and conditions of this Section 19, the more restrictive or conflicting terms and conditions in this Section 19 apply, but solely with respect to SmartLeges Softwares from the Apple App Store.<\/p>\n
7.1. Acknowledgement: SmartLeges and you acknowledge that this Agreement is concluded between SmartLeges and you only, and not with Apple, and SmartLeges, not Apple, is solely responsible for SmartLeges Software and the content thereof.\u00a0 To the extent this Agreement provides for usage rules for SmartLeges Software that are less restrictive than the Usage Rules set forth for SmartLeges Software in, or otherwise is in conflict with, the App Store Terms of Service, the more restrictive or conflicting Apple term applies.
\n7.2. Scope of License: The license granted to you for SmartLeges Software is limited to a non-transferable license to use SmartLeges Software on an iOS Product that you own or control and as permitted by the Usage Rules set forth in the App Store Terms of Service.
\n7.3. Maintenance and Support: SmartLeges is solely responsible for providing any maintenance and support services with respect to SmartLeges Software, as specified in this Agreement (if any), or as required under applicable law. SmartLeges and you acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to SmartLeges Software.
\n7.4. Warranty: SmartLeges is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of SmartLeges Software to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for SmartLeges Software to you; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to SmartLeges Software, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be SmartLeges’s sole\u00a0 responsibility.
\n7.5. Product Claims: SmartLeges and you acknowledge that SmartLeges, not Apple, is responsible for addressing any claims of you or any third party relating to SmartLeges Software or your possession and\/or use of SmartLeges Software, including, but not limited to: (i) product liability claims; (ii) any claim that SmartLeges Software fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation. This Agreement does not limit SmartLeges’s liability to you beyond what is permitted by applicable law.
\n7.6. Intellectual Property Rights: SmartLeges and you acknowledge that, in the event of any third party claim that SmartLeges Software or your possession and use of SmartLeges Software infringes that third party’s intellectual property rights, SmartLeges, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
\n7.7. Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a \u00abterrorist supporting\u00bb country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
\n7.8. Developer Name and Address: SmartLeges’s contact information for any end-user questions, complaints or claims with respect to SmartLeges Software is set forth in Section 18.10.
\n7.9. Third Party Terms of Agreement: You must comply with applicable third party terms of agreement when using SmartLeges Software
\n7.10. Third Party Beneficiary: SmartLeges and you acknowledge and agree that Apple, and Apple’s\u00a0 subsidiaries, are third party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third party beneficiary thereof.<\/p>\n
8. SmartLeges Premium. SmartLeges puede usarse en modo gratuito o a trav\u00e9s de una suscripci\u00f3n SmartLeges Premium. Los precios de SmartLeges Premium pueden variar en funci\u00f3n del pa\u00eds. La suscripci\u00f3n SmartLeges Premium es v\u00e1lida por 30 d\u00edas. El pago se cargar\u00e1 a su cuenta de iTunes, Google Play o Paypal en la confirmaci\u00f3n de la compra. La suscripci\u00f3n se renueva autom\u00e1ticamente a menos que la renovaci\u00f3n autom\u00e1tica se desactiva al menos 24 horas antes de que finalice el per\u00edodo actual. Se le cobrar\u00e1 en su cuenta se le cobrar\u00e1 el precio que aparece en la parte superior de esta pantalla de renovaci\u00f3n dentro de las 24 horas antes de la finalizaci\u00f3n del per\u00edodo actual. Las suscripciones pueden ser gestionados y renovaci\u00f3n autom\u00e1tica puede desactivarse entrando a la pantalla de Configuraci\u00f3n de la cuenta en la App Store, Google Play o Paypal despu\u00e9s de la compra. No se permite la cancelaci\u00f3n de la suscripci\u00f3n actual durante el per\u00edodo de suscripci\u00f3n. Si cursas la baja de tu suscripci\u00f3n o se suspende temporalmente por impago, podr\u00e1s descargarte la informaci\u00f3n en un archivo que generaremos para ti. Si, adem\u00e1s, decides m\u00e1s adelante volver a suscribirte, tu informaci\u00f3n volver\u00e1 a estar disponible en tu cuenta. En caso contrario, te daremos la opci\u00f3n de eliminar toda la informaci\u00f3n de forma definitiva. Una vez eliminada, ya no la podr\u00e1s volver a descargar ni recuperar en caso de renovar la suscripci\u00f3n.<\/p>\n
9. Programa de Apadrinamiento. Un usuario (en lo sucesivo Padrino) puede invitar a sus contactos a registrarse en SmartLeges y recibir\u00e1 a cambio 1 mes gratuito de suscripci\u00f3n por cada contacto (en lo sucesivo Ahijado) que se registre y se suscriba a SmartLeges Premium y adem\u00e1s mantenga la suscripci\u00f3n como m\u00ednimo 35 d\u00edas. Solo se podr\u00e1 apadrinar contactos cuyo email no est\u00e9 registrado en SmartLeges. No hay l\u00edmite en el n\u00famero de invitaciones que el Padrino puede enviar o el n\u00famero de meses gratis que puede recibir. El Padrino utilizar\u00e1 los meses gratuitos de suscripci\u00f3n obtenidos cuando se suscriba a SmartLeges Premium a trav\u00e9s de la web https:\/\/secure.smartleges.com. En caso de que ya est\u00e9 suscrito a trav\u00e9s de la web https:\/\/secure.smartleges.com, se le canjear\u00e1n los meses que obtenga en cada pago peri\u00f3dico de la suscripci\u00f3n posterior a los 35 d\u00edas desde la suscripci\u00f3n del Ahijado por medio de la devoluci\u00f3n integra del importe pagado si la suscripci\u00f3n es mensual, y en el caso de que sea un pago anual s\u00f3lo se podr\u00e1n canjear los meses gratuitos cuando tenga acumulados 12 meses gratuitos. En caso de que el Padrino haya adquirido la suscripci\u00f3n a trav\u00e9s del Play Store de Google Android o del App Store de Apple no podr\u00e1 disfrutar de los meses gratuitos a no ser que cambie a una suscripci\u00f3n web (comprada a trav\u00e9s de la direcci\u00f3n https:\/\/secure.smartleges.com). El Ahijado recibir\u00e1 un mes gratis en el momento que se registre con la misma direcci\u00f3n de correo que utiliz\u00f3 el Padrino cuando le envi\u00f3 la invitaci\u00f3n, y podr\u00e1 usarlo cuando se suscriba a SmartLeges Premium a trav\u00e9s de la web https:\/\/secure.smartleges.com. El Ahijado no podr\u00e1 disfrutar del mes gratuito de suscripci\u00f3n si decide suscribirse a trav\u00e9s del Play Store de Google Android o en el App Store de Apple. El mes gratuito de suscripci\u00f3n obtenido por el Ahijado en el momento de registrarse no es acumulable y es independiente del n\u00famero de invitaciones que haya recibido de uno o varios Padrinos. Los meses gratuitos obtenidos no son canjeables por dinero ni transferibles. <\/p>\n
10. Limitaci\u00f3n de responsabilidad. SmartLeges no constituye asesoramiento jur\u00eddico. Los textos jur\u00eddicos que aparecen se ofrecen con una finalidad informativa o divulgativa. SmartLeges intentar\u00e1 velar por la actualidad, exactitud y veracidad de los mismos, si bien advierte que no son los textos oficiales y declina toda responsabilidad por los da\u00f1os que puedan causarse debido a las inexactitudes o incorrecciones de los mismos. Los \u00fanicos textos considerados legalmente v\u00e1lidos son los que aparecen en las publicaciones oficiales de los correspondientes organismos auton\u00f3micos o nacionales. SmartLeges llevar\u00e1 a cabo, siempre que no concurran causas que lo hagan imposible o de dif\u00edcil ejecuci\u00f3n, y tan pronto tenga noticia de los errores, desconexiones o falta de actualizaci\u00f3n en los contenidos, todas aquellas labores tendentes a subsanar los errores, restablecer la comunicaci\u00f3n y actualizar dichos contenidos.<\/p>\n
En ning\u00fan caso, SmartLeges o sus desarrolladores ser\u00e1n responsables ante usted por cualquier da\u00f1o o p\u00e9rdida econ\u00f3mica, incluso si cualquier representante de la aplicaci\u00f3n ha sido advertido de la posibilidad de tales da\u00f1os. Usted acepta tener completa responsabilidad for cualquier da\u00f1o que pueda ocurrir por el uso de esta aplicaci\u00f3n.<\/p>\n
Usted acepta que si la totalidad o cualquier parte de las secciones anteriores es considerada no vinculante por cualquier Juzgado, cualquier indemnizaci\u00f3n que usted pida por cualquier da\u00f1o ocasionado no exceder\u00e1 la cantidad que usted ha pagado por el programa.<\/p>\n
11. Ley aplicable y foro. Las presentes Condiciones de Uso se regir\u00e1n e interpretar\u00e1n conforme a la legislaci\u00f3n espa\u00f1ola en aquello que no est\u00e9 expresamente establecido. SmartLeges, los usuarios de esta aplicaci\u00f3n y cualquier persona o empresa que utilice o contrate cualquier producto o servicio que se preste en la misma, con renuncia de forma expresa a cualquier otro foro que pudiera corresponderles, se someten, salvo en los casos en que no est\u00e9 legalmente permitido, a la jurisdicci\u00f3n y competencia de los Juzgados y Tribunales de la ciudad de Valencia (Espa\u00f1a), para la resoluci\u00f3n de cualquier cuesti\u00f3n que pudiera suscitarse sobre la interpretaci\u00f3n, aplicaci\u00f3n y cumplimiento de estas condiciones, as\u00ed como de las reclamaciones que puedan derivarse de cualquier uso de esta aplicaci\u00f3n.<\/p>\n
12. Cl\u00e1usula de Arbitraje. Al aceptar estas Condiciones de uso, si ocurriera un conflicto las partes acuerdan realizar una mediaci\u00f3n o arbitraje antes de llevar a cabo cualquier acci\u00f3n judicial formal. La mediaci\u00f3n o arbitraje se realizar\u00e1 en Valencia (Espa\u00f1a).<\/p>\n
